EUDR: New Official clarifications and feedback on the ATIBT/LCB workshops available for replay

The European Commission has published the 4th version of its Frequently Asked Questions (FAQ) as well as an updated version of its guidance document relating to Regulation (EU) 2023/1115, also known as the European Union Deforestation Regulation (EUDR).

These documents provide numerous clarifications and some helpful simplifications, particularly for operators and traders in the timber sector.

We especially invite you to consult:

  • Section 3.4, on the due diligence obligations expected from downstream companies, including requirements for non-SME traders;
  • Section 3.13, which clarifies the obligations of corporate groups and their subsidiaries depending on their status (operator or trader, SME or not);
  • Question 2.15, confirming that leased products are covered by the regulation if they remain within the scope of a commercial activity;
  • Answers 5.22, 5.6.1, and 5.4, relating to due diligence obligations for the re-export or re-import of previously exported products.

We will soon update our ATIBT/LCB FAQ to incorporate these new developments. This will include an explanatory note based on concrete cases, adapted to the realities of the timber trade.

 

Draft Delegated Act Amending Annex I
The European Commission has also launched a four-week public consultation on a draft delegated act aiming to amend Annex I of the EUDR. The public consultation is open until May 13, 2025.

This draft includes, among other things:

  • The addition of the “ex” prefix to many tariff lines, in order to restrict the application of the EUDR to products that are actually made from the relevant raw materials;
  • The exclusion of certain types of products—such as samples or products intended for analysis or testing—from the scope of the regulation.

 

EUDR Workshops by ATIBT and LCB
LCB and ATIBT have launched a series of workshops to help companies better understand the EUDR.

Two initial workshops were held in April:

Two new workshops are scheduled for May:

  • On May 6 at 2:00 PM: a session on analyzing GPS coordinates (registration link);
  • On May 27 at 2:00 PM: a session on assessing forest degradation risks (registration link).

Please note that the workshops are conducted exclusively in French.
